By accessing or using the Website or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. Career Catalyst Academy provides online courses, career coaching, and interview preparation services designed to help individuals improve their job search skills and advance their careers, specifically tailored to the Australian job market. Our Services may include access to course materials, live coaching sessions, mock interviews, resume and cover letter reviews, and other resources related to career development. We also may from time to time partner with Australian businesses to provide recruitment and job placement opportunities.

3. User Accounts

To access certain features of the Services, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Career Catalyst Academy immediately of any unauthorized access to or use of your account. We reserve the right to suspend or terminate your account if we believe that you have violated these Terms or that your account has been compromised.

4. Payment and Fees

Some of our Services may require payment of fees. You agree to pay all applicable fees for the Services you purchase. We may use a third-party payment processor to process payments. You are responsible for providing accurate and complete payment information. All fees are stated in Australian Dollars (AUD) unless otherwise specified. We reserve the right to change our fees at any time, but any changes will not apply to Services you have already purchased. Refunds are subject to our Refund Policy, which is outlined in Section 5.

5. Refund Policy

We strive to provide high-quality Services and ensure customer satisfaction. If you are not satisfied with a purchased Service, you may be eligible for a refund. Our refund policy varies depending on the type of Service:

• Online Courses: You may request a full refund within 14 days of purchase, provided that you have not completed more than 20% of the course material.
• Career Coaching Packages: You may request a refund for unused coaching sessions within 30 days of purchase. Once coaching sessions have commenced, the refund amount will be prorated based on the number of sessions completed.
• Resume and Cover Letter Reviews: Due to the personalized nature of these services, refunds are only available if requested before the review process has begun.

To request a refund, please contact our customer support team at support@careercatalyst.com.au with your order details and reason for the refund request. All refund requests are subject to review and approval by Career Catalyst Academy. Approved refunds will be processed within 10 business days.

6. Intellectual Property

All content and materials available on the Website and through the Services, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, are the property of Career Catalyst Academy or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content or materials without our prior written consent, except as expressly permitted by these Terms.

Specifically, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and Services for your personal, non-commercial use. This license does not include any right to:

• Use any data mining, robots, or similar data gathering or extraction methods.
• Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information of Career Catalyst Academy.
• Use any meta tags or any other "hidden text" utilizing Career Catalyst Academy's name or trademarks.
• Reverse engineer, decompile, or disassemble any software or other products or processes accessible through the Website or Services.

7. User Content

You may be able to submit content to the Website or through the Services, such as comments, feedback, or testimonials ("User Content"). You retain ownership of your User Content, but by submitting it, you grant Career Catalyst Academy a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media. You represent and warrant that you have all necessary rights to grant the licenses in this section and that your User Content does not violate any third-party rights or applicable laws.

Career Catalyst Academy reserves the right to remove any User Content that violates these Terms or that we deem to be inappropriate, offensive, or harmful.

8. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations.
• Infringing on the intellectual property rights of Career Catalyst Academy or any third party.
• Transmitting any viruses, malware, or other harmful code.
• Interfering with or disrupting the Website or Services.
• Attempting to gain unauthorized access to any part of the Website or Services, or to any other user's account.
• Engaging in any fraudulent or deceptive activity.
• Harassing, threatening, or intimidating any other user.

To the fullest extent permitted by applicable law, Career Catalyst Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your access to or use of the Website or Services, even if we have been advised of the possibility of such damages. In no event shall Career Catalyst Academy's total liability to you for all claims arising out of or relating to these Terms or the Website or Services exceed the amount you have paid to Career Catalyst Academy for the Services in the twelve (12) months preceding the date of the claim.

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of New South Wales, Australia, and you consent to the jurisdiction of such courts.

We will post any changes on the Website, and the revised Terms will be effective immediately upon posting. Your continued use of the Website or Services after the posting of any changes constitutes your acceptance of the revised Terms.
